  2. NEHGS End User License Provisions

  4. Restrictions:  You may not and you may not permit 
  5. others to (a) disassemble, decompile or otherwise derive 
  6. source code from the Software or data or any part 
  7. thereof, (b) reverse engineer, reverse assemble, reverse 
  8. compile or otherwise translate the Software or data or 
  9. any part thereof, (c) modify or prepare derivative works 
  10. of or from the Software or data or any part thereof, (d) 
  11. copy the Software or data, except to make a single copy 
  12. for archival purposes only, (e) rent, lease, sell, distribute 
  13. or sublicense the Software or data or any part thereof, 
  14. (f) use the Software or data or any part thereof in any 
  15. manner that infringes the intellectual property or other 
  16. rights of another party, or (g) transfer the Software or 
  17. data or any part thereof or any copy thereof to another 
  18. party, unless you transfer all media and written 
  19. materials in this package and retain no copies of the 
  20. Software or data (including prior versions of the 
  21. Software) for your own use.  By moving the Folio Views application to your hard drive, you do hereby agree to the above stated license provisions.

  23. Limited Warranty and Limitation of Liability:  For a period 
  24. of 60 days from the date the Software is acquired by you, the 
  25. Publisher warrants that the media upon which the Software 
  26. resides will be free of defects that prevent you from loading 
  27. the Software on your computer.  The Publisher's sole 
  28. obligation under this warranty is to replace any defective 
  29. media, provided that you have given the Publisher notice of 
  30. the defect within such 60-day period.  Except for such limited 
  31. warranty, the Software is licensed to you on an "AS IS" basis 
  32. without any warranty of any nature.  THE PUBLISHER 
  33. DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR 
  34. IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF 
  35. MERCHANTABILITY AND FITNESS FOR A PARTICULAR 
  36. PURPOSE.  THE PUBLISHER SHALL NOT BE LIABLE FOR 
  37. ANY DAMAGE OR LOSS OF ANY KIND ARISING OUT OF 
  38. OR RESULTING FROM YOUR POSSESSION OR USE OF 
  39. THE SOFTWARE (INCLUDING DATA LOSS OR 
  40. CORRUPTION), REGARDLESS OF WHETHER SUCH 
  41. LIABILITY IS BASED IN TORT, CONTRACT OR 
  42. OTHERWISE.  IF THE FOREGOING LIMITATION IS HELD 
  43. TO BE UNENFORCEABLE, THE PUBLISHER'S MAXIMUM 
  44. LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT OF 
  45. THE LICENSE FEES PAID BY YOU FOR THE SOFTWARE.  
  46. THE REMEDIES AVAILABLE TO YOU AGAINST THE 
  47. PUBLISHER UNDER THIS AGREEMENT ARE EXCLUSIVE.  
  48. SOME STATES DO NOT ALLOW THE LIMITATION OR 
  49. EXCLUSION OF IMPLIED WARRANTIES OR LIABILITY 
  50. FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO 
  51. THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT 
  52. APPLY TO YOU.
